East York Curling Club is committed to collecting, using, and disclosing your personal information responsibly and to maintaining the accuracy, confidentiality, and security of such personal information. We do not sell, rent, or lease any of your personal information to third parties.

Personal information includes information that tells us specifically who you are, such as your address, telephone number and e mail address. However, publicly available information, such as a public directory listing of your name, address and telephone number is not considered personal information.

We have adopted the following privacy policy that guides how we collect, use and disclose personal information about our members and prospective members. Our intent is to balance our legitimate operating interests in collecting, using, and disclosing your personal information against your reasonable expectations of privacy.

1. Definitions
In this policy:
• "Operations" means the business of operating the East York Curling Club which includes the Web site;
• "Membership" means a membership in the East York Curling Club;
• "we", "us", "our" and the "Club" refer to the East York Curling Club, located at 901 Cosburn Avenue, Toronto, and/or www.eastyorkcurling.ca
• "Web site" refers to the web site found at www.eastyorkcurling.ca

2. Collection of Personal Information
Our primary purpose in collecting personal information from you and about you is to ensure the provision of high quality products and/or services. We only collect personal information from and about you that we consider necessary for achieving this purpose and to permit us to conduct the Operations diligently.

3. Use of Your Personal Information
We may use the personal information we collect from and about you to:
• ensure the provision of high quality membership services;
• inform you about online and offline offers, membership services, updates and events (including expiry and renewal of your Membership);
• enable us to contact you;
• establish and maintain communication with you;
• assist us in complying with legal and regulatory requirements;
• invoice you for products and/or services;
• collect unpaid accounts;
• enable a corporate re-organization, a merger, or acquisition with another entity;
• provide you with information concerning the Operation of the Club.

We may also use your personal information as may be described to you at the time of collection. We may compare and review your personal information for errors and omissions and for accuracy. If you choose to provide us with your financial information, we may use your address and financial information to bill you and to provide associated support. We may use personal information about you, in a non-personally identifiable manner, to improve our marketing and promotional efforts, to analyse Memberships, to improve our content and product offerings, and to customize our Web site's content, layout, and services. These uses are to enable us to improve the Operations and to better tailor the Operations to meet your needs.

4. Disclosure of Personal Information
As a matter of policy, we do not sell, rent, or lease any of your personal information to third parties. However, there are a variety of circumstances where we may need to disclose some of your personal information, including the following:
• We may disclose your personal information to an individual who, in our reasonable judgement, is seeking the information as your agent. For example, we may provide your personal information to your legal representative if we are satisfied that the individual is requesting the information on your behalf.
• We may disclose your personal information as may be required by law.
• We may aggregate personal information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for marketing and promotional purposes.

5. Control of Your Password
You are responsible for all actions taken with any user ID and/or password used to access the Web site. Therefore, we recommend that you not disclose your password to any third parties. If you choose to share your user ID, your password or your personal information with a third party, you are responsible for all actions resulting therefrom. If you lose control of your password, you may lose substantial control over certain personal information. Therefore, if your password has been compromised for any reason, you should immediately change your password.

6. Access, Review, Change and Destruction of Your Personal Information
You may access, review and/or change the personal information we have in our files by submitting a written request to do so to our Privacy Information Officer at the address below; or alternatively you may access your account by logging into the Club website and amending your profile. We ask that you promptly advise us (or amend your profile) of any changes to your information. Upon your written request, we will destroy, as soon as reasonably possible and in accordance with our internal policies and applicable law, any and all personal information that we have in our files about you. Notwithstanding the foregoing, we will retain in our files some personal information in order to enable us to collect any unpaid accounts and/or as may be required by law.

7. Other Information Collectors
Except as otherwise expressly included in this Privacy Policy, this document only addresses the collection, use and disclosure of personal information we collect from and about you. To the extent that you disclose your personal information to other parties, different rules may apply to their collection, use or disclosure of such personal information. Since we do not control the privacy policies of third parties, you are subject to the privacy policies of such third parties.

8. Protecting Your Privacy
The personal information that is retained by us is kept in a secure environment and we use reasonable procedural and technical safeguards to protect your personal information against loss, theft and unauthorized access or disclosure. While we employ many different security techniques to protect such data from unauthorized access by users inside and outside the Club, we cannot ensure perfect security, particularly in relation to the Web site.

9. Amendments to This Policy
We may amend this Privacy Policy at any time by mailing (including regular mail and email) any amended terms to you or and by posting the amended terms on the Web site or at the East York Curling Club (901 Cosburn Avenue, Toronto). All amended terms shall automatically be effective five days (5) days after mailing or on the date of posting.

All cancellations/withdrawals must be initiated, and followed in writing, prior to the third day of curling in the members regularly scheduled league. No refunds or credits will be issued after this date. Please speak to the Office if you experience an injury, re-location or highly exceptional circumstances that you believe warrant review.

Withdrawals will be pro-rated based on the date the Withdrawal/Refund Request Form is received by the Office, not based on attendance in the program. Please contact the Office for the appropriate form. 

A $40 administration fee will be deducted per person, per section for all refunds after the returning member deadline. Refunds will only be applicable on the playing fee portion of the curling dues.

  • Items brought forward to the Board will be acknowledged and discussed at the next scheduled Board Meeting. Any items brought to individual Board Members will be brought forward to the entire Board for further discussion. 
  • Items submitted at least one week in advance of the next scheduled Board Meeting will be added to the agenda. Items submitted after this time will be brought up in New Business.
  • The Board meets monthly during the curling season. The dates of the Board meetings for the current season are listed below. Board meetings are open to members to attend (if you plan to attend, please advise the Club manager in advance so seating can be arranged – attendance is only in person). 
  • A Special Meeting of EYCC Members can be requested in writing by a minimum of 25 members. 
  • Anyone wanting to respond or appeal a Board decision can follow the process outlined in the Code of Conduct Complaints Review Process.

· Participate in the game of curling with honesty, integrity, courtesy, and sportsmanship both on and off the ice.

· Treat all Club members, staff, and guests with respect, kindness, and consideration.

· Follow the rules of the sport of curling and interpret those rules in a fair and impartial way.

· Demonstrate respect for teammates and opponents, whether they are winning or losing. This includes modesty in victory and composure in defeat.

 

As a member of the East York Curling Club, I agree that the Curling Club must be a place where all members, staff, guests, and volunteers feel safe and respected. Therefore, I will:

· Follow all rules laid out by the East York Curling Club and the City of Toronto with respect to conduct at the East York Curling Club.

· Act in a manner that respects other people, and so I will not engage in behaviour that can cause discomfort to others at the Curling Club including (but not limited to): negative comments or unsolicited criticism about a player’s abilities, language or comments that could be considered demeaning, display of inappropriate materials, inappropriate disclosure of others’ personal information, excessive broom slapping or throwing, or encouraging or assisting other people to violate the Code of Conduct.

· Never engage in behaviour which can be taken as (but are not limited to): threatening, insulting, intimidating, violent, discriminating, bullying, harassment, or an unwanted sexual advance.

· Not abuse or damage any property of the East York Curling Club.

I agree to the process of reviewing a complaint if I am the subject of a complaint. If I am found to be in violation of the Code of Conduct by the East York Curling Club Board of Directors, then I accept their judgement and the sanctions, if any, that are applied to me.

 

By becoming a member of the East York Curling Club, I accept the East York Curling Club’s Code of Conduct and I agree to conduct myself in accordance to the Code and Conduct.


 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

2.  As a participant in the sport of curling and the activities, programs, classes, services provided and events sponsored or organized by:

Curling Canada, Ontario Curling Association, East York Curling Club including but not limited to: games, tournaments, practices, training, personal training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientational or instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the “Activities”), the undersigned acknowledges and agrees to the following terms outlined in this agreement:

Curling Canada, Ontario Curling Association, East York Curling Club and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.


Description and Acknowledgement of Risks

4. I understand and acknowledge that:

  1. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life. The sport of curling is played on a sheet of ice, which is slippery, hard, and dangerous;
  2. A pertinent risk to participating in the sport of curling is the risk of suffering serious head injury should I fall, trip, or stumble onto the ground or ice. It is highly recommended that I wear a helmet at all times when participating in the sport of curling;
  3. The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and COVID-19
  4. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that I will not become infected with COVID-19. Further, participating in the Activities could increase my risk of contracting COVID-19.

5. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to:

  1. Health: executing strenuous and demanding physical techniques, physical exertion, overexertion, stretching, dehydration, fatigue, cardiovascular workouts, rapid movements and stops, lack of fitness or conditioning, traumatic injury, bacterial infections, rashes, and the transmission of communicable diseases, including viruses of all kinds, COVID-19, bacteria, parasites or other organisms or any mutation
  2. Premises: defective, dangerous or unsafe condition of the facilities; falls; collisions with objects, walls, equipment or persons; dangerous, unsafe, or irregular conditions on floors, ice, or other surfaces, extreme weather conditions; travel to and from
  3. Use of Equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of or the failure by the Organization to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to use or operate the equipment within my own ability.
  4. Contact: contact with brooms, brushes or curling stones, other equipment, vehicles, or other persons, and may lead to serious bodily injury, including but not limited to concussions and/or other brain injury, or serious spinal
  5. Advice: negligent advice regarding the Activities.
  6. Ability: Failing to act safely or within my own ability or within designated areas.
  7. Sport: the game of curling and its inherent risks, including but not limited to, running, sliding or slipping on the ice surface, delivering the curling stone, skipping or sweeping, stepping onto the ice surface from the walkway or onto the walkway from the ice surface, or stepping over dividers that divide one sheet of ice from the next.
  8. Cyber: privacy breaches, hacking, technology malfunction or damage.
  9. Conduct: My conduct and conduct of other persons including any physical altercation between participants.
  10. Travel: Travel to and from the Activities.
  11. Negligence: My negligence and negligence of other persons, including NEGLIGENCE ON the PART OF THE ORGANIZATION, may increase the risk of damage, loss, personal injury or death. I understand that the Organization may fail to safeguard or protect me from the risks, dangers and hazards of curling programs, some of which are referred to

6. In consideration of the Organization allowing me to participate in the Activities, I agree:

  1. That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select;
  2. That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;
  3. To comply with the rules and regulations for participation in the Activities;
  4. To comply with the rules of the facility or equipment;
  5. That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;
  6. The risks associated with the Activities are increased when I am impaired and I will not to participate if impaired in any way;
  7. That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity;
  8. That I am responsible for my choice of safety or protective equipment and the secure fitting of that equipment;
  9. Covid-19: that COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death.

Release of Liability and Disclaimer

7. In consideration of the Organization allowing me to participate, I agree:

  1. That the sole responsibility for my safety remains with me;
  2. To ASSUME all risks arising out of, associated with or related to my participation;
  3. That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities;
  4. To WAIVE any and all claims that I may have now or in the future against the Organization;
  5. To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the Activities;
  6. To FOREVER RELEASE and INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;
  7. To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;
  8. That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;
  9. That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and
  10. This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction

8. I agree that in the event that I file a lawsuit against the Organization, I will do so solely in the Province of Ontario and further agree that the substantive law of the Province of Ontario will apply without regard to conflict of law rules.


 Acknowledgement

9. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.

CURLING CANADA - INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT
For Participants Under the Age of Majority

 

WARNING!   Parent or Guardian, please read carefully. By signing this document, you will assume certain risks and responsibilities.

2. As a Participant in the sport of curling and the activities, programs, classes, services provided and events sponsored or organized by

Curling Canada,         Ontario Curling Association,        East York Curling Club

(collectively the “Organization”), including but not limited to: games, tournaments, practices, training, personal training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientational or instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the “Activities”), the undersigned being the Participant and Participant’s Parent/Guardian (collectively the “Parties”) acknowledges and agrees to the following terms outlined in this agreement:

3. I am the Parent/Guardian of the Participant and have full legal responsibility for the decisions of the Participant.

4. The Parties understand and acknowledge that:

  1. 6. In consideration of the Organization allowing the Participant to participate in the Activities, the Parties agree:

  1. That when the Participant practices or trains in their own space, the Parties are responsible for the Participant’s surroundings and the location and equipment that is selected for the Participant;
  2. That the Participant’s mental and physical condition is appropriate to participate in the Activities and the Parties assume all risks related to the Participant’s mental and physical condition;
  3. To comply with the rules and regulations for participation in the Activities;
  4. To comply with the rules of the facility or equipment;
  5. That if the Participant observes an unusual significant hazard or risk, the Participant will remove themselves from participation and bring their observations to a representative of the Organization immediately;
  6. The risks associated with the Activities are increased when the Participant is impaired, and the Participant will not participate if impaired in any way;
  7. That it is their sole responsibility to assess whether any Activities are too difficult for the Participant. By the Participant commencing an Activity, they acknowledge and accept the suitability and conditions of the Activity;
  8. That COVID-19 is contagious in nature and the Participant may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and,
  9. That they are responsible for the choice of the Participant’s safety or protective equipment and the secure fitting of that equipment.

7. In consideration of the Organization allowing the Participant to participate, the Parties agree:

  1. That the Parties are not relying on any oral or written statements made by the Organization or their agents, whether in brochure or advertisement or in individual conversations, to agree to participate in the Activities;
  2. That the Organization is not responsible or liable for any damage to the Participant’s vehicle, property, or equipment that may occur as a result of the Activities; and
  3. That this Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction

8. The Parties agree that in the event that they file a lawsuit against the Organization, they agree to do so solely in the Province of Ontario and they further agree that the substantive law of the Province of Ontario will apply without regard to conflict of law rules.


 Acknowledgement

9. The Parties acknowledge that they have read this agreement and understand it, that they have executed this agreement voluntarily, and that this Agreement is to be binding upon themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators and legal or personal representatives.



 

 

Consent to Photograph / Videotape / Audiotape / Film / Interview Individuals 

I give East York Curling Club permission to photograph, videotape, audiotape, film and/or interview either myself, or the person on whose behalf I am giving permission, and to publish the recordings in East York Curling Club's publications/material, including the East York Curling Club website, marketing and promotional materials, both now and in the future.

The recordings shall constitute the property of the East York Curling Club and may be reproduced by the organization and anyone it has authorized, without compensation or payment to the individual(s) being recorded or any other person.

If I am providing this permission on behalf of someone other than myself, I warrant that I have the authority to do so.


 

If you have selected to pay in two installments, a reminder email will be sent near the end of August. The balance of fees must be paid in full online or by mail by August 31st, 2024.

Lockers will be assigned on a first come, first served basis to adult members. Each member can only apply for ONE locker. Members can either use their own lock or use the lock provided on the locker. If you are using your own lock, please return the Club lock on the locker back to staff. At the end of the season, please leave the club lock in the provided drop box or in your locker when you clear out your belongings. You will be notified once you can move in for the season.
